INTRODUCTION
These Terms of Use apply to your purchases on, and your use of, the website “www.joeylang.com”. These terms and conditions constitute an agreement between you and JA Shades AB, registered in Sweden with org. No. 559212-4894, Astilbevägen 12, 218 34 Bunkeflostrand (hereinafter “JA Shades”, “JOEY LANG”, “we” or “us”).

By making purchases from and using this website you agree to the following terms. Please read the terms carefully before using our website.

JOEY LANG currently only accepts orders from organizations and individuals with a shipping and/or billing address in Sweden, Denmark, Germany and Finland.


ORDER CONFIRMATION AND RECIEPT/INVOICE

Once we have received an order from you, we will send an electronic order confirmation to your e-mail address, as a confirmation of your purchase. We will ship your order within 24 hours from the confirmation. When your order is shipped you will receive an order update with you tracking number. Within 48 hours we will also send a receipt/invoice for the payment of your order. It is therefore important that you enter the correct e-mail address in connection with your order. We recommend that you save the order confirmation and receipt/invoice to facilitate any future contact with our customer service.

PAYMENT
You can pay with debit and credit card. All payments for purchases made through our website are managed by Stripe. JOEY LANG does not handle any debit or credit card numbers.

PAYMENT WITH CARD
Pay securely with Visa, Amex or MasterCard via the internet. Your payment is handled by Stripe with secure encryption according to strict banking standards. Our payment system is compliant with the new European Payment Directive (PSD2). Your card details are sent directly to the bank and cannot be read or retrieved by anyone other than your bank. We do not charge any extra fees for card payments. However, your bank may charge an additional fee depending on the card type and bank. When paying by credit or debit card, these terms become effective as soon as the card transaction has been approved. In the event that no payment is received after you send your order, the order may automatically be canceled by us.

PRICES
All prices displayed on our website, www.joeylang.com, are in SEK inclusive of VAT, in accordance with applicable law. Customers will be charged in SEK regardless of country of origin.

ORDERS AND CANCELATION
Orders made in someone else’s name without their consent will be notified to the police. JOEY LANG reserves the right to change and correct prices on all orders, including final purchases. If the price is incorrect, this can cause JOEY LANG to cancel the purchase and repay the current amount in the best possible way. This can be done at any time.


WARRANTY

Warranty conditions: One year from the date of purchase. The warranty covers manufacturing defects on the sunglasses themselves (frame, glass). Parts other than those previously stated are not covered by this warranty. If you would like a replacement product or request repair for goods covered by this warranty, contact is made by email to “customerservices@joeylang.com”. In the email you will need to enter the name, address, order number and a detailed description of the fault. Write “warrenty” as a subject heading in your email. The return shipping is paid by us. If we do not find any of the defects described above, the product will be returned to the customer.

Please note that repairs / replacements will be charged in the following cases, even if they occur during the warranty period:
a) Faults or damage caused by improper use or negligence (impact, dents, crushing, broken glass, etc.).
b) Faults or damage caused by improper repair or modification.
c) Faults or damage caused by fire, water or a natural disaster such as an earthquake.
d) Aesthetic changes that occur as a result of normal use or aging (minor scratches or similar on glass or frame, color changes).
e) If the point of purchase and date of purchase is not stated on the order confirmation or receipt/invoice, or if this information has been added later.
f) If order confirmation or receipt/invoice is not sent with the sunglasses.

Glass or other parts can be replaced with equivalent parts if the originals are not available. This warranty entitles the customer to a free replacement product in accordance with the terms stated herein and within the specified time period, and does not limit the customer’s legal rights.

PERSONAL INFORMATION
When you shop on our website, we will save some of your personal information for you to complete your purchase. You have the right to request access to your data and if any information is incorrect you may have it changed or deleted. JOEY LANG may also use cookies, for example, to improve your experience of this website. You can read more about how we use personal data and cookies in our “Privacy Policy”.

PRODUCT INFORMATION

JOEY LANG has the right to adjust prices, including price increases, make changes to the product range and related information without prior notice. The purpose of the product images and information texts provided by JOEY LANG is to provide the most accurate and true-to-life image of the products. We strive to ensure that all content displayed on this site is accurate, but errors can nonetheless occur. JOEY LANG cannot guarantee that all product images will reflect the actual appearance of the products and therefore all product images should be considered as illustrations. Please note that the product images may vary depending on the color settings of the computer.

DELIVERIES AND CANCELATIONS
We aim to deliver our products worldwide. However, only orders to Swedish, Danishm, German and Finnish addresses in collaboration with Postnord are currently accepted.

You have the right to cancel an order and return the goods by contacting our customer service at email address “customerservices@joeylang.com”, within 30 days of receiving the goods. However, this is provided that the goods are not unpacked and are in the same condition as when you received them. The cost and risk of transporting goods you want to return to JOEY LANG is imposed on the customer.

In the event that you as a customer feel that the delivery of an item is unusually delayed, which causes you to no longer wish to complete the purchase, it is up to you to cancel. If the shipment has already been shipped, the customer must receive the order. A cancellation is not valid until a confirmation has been received from JOEY LANG either via email or telephone.

If a product is no longer sold, JOEY LANG has the right to cancel the purchase and make a refund. JOEY LANG will notify the customer if a replacement item or equivalent product is available.

CUSTOMER COMPLAINTS
It is important that you as a customer carefully examine the product when you receive it. If your item is damaged during transport, you must report this to the carrier as soon as possible. This applies whether it is a visible injury or not. If, upon receipt of the item, you find that it is damaged or does not match the item you ordered, you should contact us within 30 days via email.

Any complaints should be made to our customer service via email, to: customerservices@joeylang.com. Please provide us with your order number and the reason for your complaint and we will come back to you with further instructions on returning the item or handling the case.

Incorrect products returned to us should still be treated with care by the customer and as if they were faultless. Regardless of the reason for return, it is of great importance that the product is packed so that it cannot be damaged during transport. In the event that a returned product has no defects, JOEY LANG will return the product to the customer. If a product is to be replaced, this is done against a product of the corresponding model. If a certain product no longer exists, the customer is entitled to a refund instead.

If a dispute arises between you as a customer and JOEY LANG and we are unable to resolve the dispute, you can send a complaint to the EU’s Dispute Resolution online function, Online Dispute Resolution. More information can be found at the following link http://ec.europa.eu/odr.

LIABILITY

JOEY LANG’s liability for errors in connection with delivery is limited in accordance with applicable delivery terms for the relevant delivery and what follows from these terms.

Our liability to you for any losses or damages arising from your order on “www.joeylang.com” is limited to the total amount of your order. JA Shades AB has no responsibility for indirect losses.

FORCE MAJEURE
JOEY LANG shall be exempt from liability and other penalties caused by circumstances beyond JOEY LANG’s control. Such circumstances include, for example, state intervention, new / amended legislation, wars, fires, floods, interruptions in work, prohibitions, restrictions, sabotage, poor transport and weather conditions, non-delivery from suppliers or that JOEY LANG or its partners would be exposed for criminal activity.

USER-GENERATED CONTENT
Our website may include user-generated content from, for example, social media. JOEY LANG takes no legal responsibility for such material. In the event that you suspect a copyright infringement, or infringement of another right, or for any other reason, you feel violated by content posted on the Web site, please contact our customer service.

OWNERSHIP
All products remain JA Shades AB’s property until full payment is made.

FRAUD
All fraud attempts are reported to the police. We reserve the right to cancel a purchase if any suspicion of a crime is raised.

APPLICABLE LAW AND JURISDICTION
Swedish law applies to these terms and your use of this website. To the extent permitted by law, the Swedish court shall have exclusive jurisdiction with respect to any dispute arising out of these terms or your use of the Website, except in cases where JOEY LANG chooses to take legal action against a customer / user where it has its residence.

TERMINATION
We reserve the right to terminate your account and / or your use of the Website at our sole discretion. For example, if we suspect you have violated these terms and conditions. Such termination may be made without prior notice thereof.

VALIDITY OF CLAUSES
If one or more of these conditions is declared invalid or pronounced as ineffective by a court or supervisory authority, this shall not affect the validity of the remaining conditions.

INTELLECTUAL PROPERTY RIGHTS

The intellectual property rights, such as trademarks and copyrights, on www.joeylang.com, which belong to JA Shades AB may not be used for commercial purposes without our permission. All use of www.joeylang.com or its contents, including copying or storing such content in its entirety or parts thereof, other than for your own personal, non-commercial use, is prohibited without the permission of JOEY LANG.  This website is exclusively owned by JA Shades AB. All material contained in this web site is reserved by JOEY LANG.

CHANGES
We may revise these Terms and Conditions from time to time. Every time you buy an item from us, they will apply to the contract between you and JOEY LANG at that time. Therefore, you should regularly visit this page to keep up to date on the content of our Terms and Conditions.
